If The Cops Search Your Home

If The Cops Search Your Home

Obviously if the cops come to search your home, there's not much you can do to stop them. However, make sure that they're not just coming to ask you to turn down your music or to ask you if you saw somebody running in some direction. If they're coming to search your home, you probably won't see or hear them until they're inside.

If the cops do bust down your door, flushing drugs down the toilet often works, but rare that you could get to the bathroom in time, or even collect your drugs in time to make that feasible. If the cops screw up somehow, and you see them getting ready to bust in on your house, grab your drugs and head to the bathroom and as soon as you hear them shouting and busting down your door, flush everything. But don't do it before. If cops are swarming around your house, they're probably interested in your neighbor instead of you, so there's no reason to panic until you hear them actually busting into your home.

In the book, Marijuana Law, there was an example of a woman who's apartment was raided. She broke free from a police officer, ran to the bathroom and locked the door. When they dragged her out of the bathroom, they found nothing on her and no drugs in her apartment, but another officer found a big bag of pot lying on the ground directly underneath her bathroom window. They charged her with possession, but she fought the charge and won, because there were many other apartments in that building and the police didn't have conclusive evidence that it came from hers. This was probably a screw-up on their part, though, as they should have had other officers watching the back of the apartment. If an officer had seen her throw it out the window, there would have been more than enough evidence.

So basically, in the unfortunate event that you're ever raided, (as I have never been), there's not much you can do other than just sit down, read the search warrant front to back, and hope that your hiding places are good enough to fool the cops. Make sure the warrant is signed by a judge. Check the warrant for special restrictions on the search, and hold the officers to it. Do not allow them to overstep their legal bounds. For example, if you live with your parents, and the warrant lists only your bedroom in the search list, do not let the officers stray from that search area, unless by allowing them to stray, they are leading themselves away from your hidden stash.

Be mature about the situation, and let the cops see that you know your rights. Ask questions about anything you don't understand in the warrant. You never know, you might uncover something they're being deceitful about.

Don't fight with the officers. Don't yell at them. Don't give them any reason to dislike you. The more you piss them off, the harder they'll search. Perhaps even make friendly conversation with them in order to distract them from their task.

In the fortunate event that you've hidden your pot well enough to keep them from finding it, the cops will probably try to intimidate and trick you into giving a clue to it's location. Make sure that you're not so nervous that you're staring at your hiding place. The best thing to do is keep your mouth shut whenever possible. Tell them you want a lawyer.
